1. Reservations and Payment

• All rentals must be booked through our online reservation system.

• Full payment is required at the time of booking. Your reservation is confirmed when you receive a confirmation email.

• Availability is limited and equipment is reserved on a first‑come, first‑served basis.

 

2. Operating Days

• Shady Beaches operates daily in Cherry Grove from May 29 through September 13, 2026.

• Your rental begins and ends at the times stated in your confirmation (9:30am- 4:30pm).

 

3. Weather & Wind Safety

Beach conditions can change quickly. For safety reasons, umbrellas and cabanas may need to be lowered or removed during higher winds (generally above 15–20 mph).

• Only Shady Beaches staff can move, adjust, install, or remove equipment.

• Safety decisions are made at the sole discretion of the Shady Beaches team.

• Weather‑related changes do not guarantee refunds, except as noted in Section 4 (Cancellations & Refunds).

Umbrella Flyaway Clause:
The Renter assumes full responsibility for any damage or injury caused by moving, loosening, or reinstalling umbrellas or cabanas. Shady Beaches is not liable for equipment altered by Renters.

 

4. Cancellations & Refunds

At Shady Beaches, we understand that plans can change. 

• Cancellations requested by e-mail at least 24 hours before your scheduled reservation start time will receive a full refund. 

• Cancellations requested by e-mail less than 24 hours before your scheduled reservation start time will receive a 50% refund.

• If Shady Beaches must cancel your reservation due to unsafe weather or beach conditions, you will receive a full refund.

• Reservations that are not canceled and are not used ("no shows") are non-refundable.

 

5. Use of Equipment and Responsibility

This Agreement applies to all rental equipment and services provided by Shady Beaches—including chairs, umbrellas, cabanas, coolers, tables, towels, Bluetooth speakers, phone chargers, beach games, and any related services.

• All equipment must be used responsibly and only as intended.

• Children must be always supervised.

• You are responsible for all equipment during your rental period.

• Notify a Shady Beaches team member immediately if equipment is unsafe or damaged.

• Do not move, adjust, reinstall, or tamper with any equipment.

 

6. Setup, Movement, and Abandonment

• All equipment is installed and removed by Shady Beaches staff.

• All equipment remains the property of Shady Beaches.

• Unattended or abandoned setups may be removed at our discretion.

• Personal belongings left with rental equipment are left at your own risk.

 

7. Assumption of Risk

The beach is a natural environment with inherent risks, including wind, sand, changing weather, ocean conditions, and potential equipment movement or malfunction. Cherry Grove, Fire Island does not have lifeguards; swimming is at your own risk. By renting equipment, you voluntarily assume all risks associated with beach activities and equipment use.

 

8. Release of Liability

To the fullest extent permitted under New York law, you release Shady Beaches, its owners, employees, contractors, and agents from liability for personal injury, property damage, loss, theft, or accidents arising from equipment use, beach conditions, or recreational activities, including those related to wind or weather events, except to the extent caused by our gross negligence or willful misconduct.

 

9. Indemnification

You agree to indemnify and hold harmless Shady Beaches, its owners, employees, contractors, and agents from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from your misuse of equipment, negligence, violation of this Agreement, or unauthorized movement/alteration of equipment.

 

10. Age Requirement

You must be at least 18 years old to reserve rental equipment.

 

11. Photos and Branding

Shady Beaches may photograph or record equipment setups for marketing purposes. Individuals will not be identified without consent. All branding, images, and content associated with Shady Beaches are protected and may not be used without our written permission.

 

12. Charge Authorization

By completing a purchase, you authorize Shady Beaches LLC to charge the card on file for rental fees, applicable cancellation fees, or equipment damage or replacement fees as outlined in this Agreement and Appendix A.

 

13. Governing Law and Venue

This Agreement is governed by New York State law. Any disputes will be resolved exclusively in the state courts of New York.

 

14. Right to Refuse Service

Shady Beaches reserves the right to refuse or cancel service due to unsafe conditions, misuse of equipment, noncompliance with this Agreement, or inappropriate conduct. If service is refused or canceled due to your conduct or misuse, refunds may not be issued.

15. Changes to Terms

We may update these terms from time to time. The version in effect at the time of your reservation will apply unless changes are required by law or for safety.

16. Miscellaneous

• Severability: If any provision is found invalid, the remaining provisions remain in effect.

• Entire Agreement: This Agreement, including Appendix A (Beach Equipment Agreement), constitutes the entire agreement between you and Shady Beaches regarding your rental.

• No Waiver: Failure to enforce any provision is not a waiver of our rights.

 

Appendix A: Beach Equipment Agreement

A few simple guidelines to keep everyone smiling.

By completing your reservation with Shady Beaches, you agree to the terms below.

Your Equipment

• Everything set up for you is your responsibility during your reservation.

• Please use all items as intended and keep them in the same condition you received them, allowing for normal wear and tear.

• If you notice any damage at setup, let us know right away. Unreported pre‑existing damage may be assumed to have occurred during your reservation.

 

Damage, Loss, or Theft

We approach accidents reasonably and fairly.

• Minor accidental damage consistent with normal use: we aim to be fair.

• Damage caused by misuse, reckless handling, or failing to secure equipment in rough conditions may be charged up to the full replacement cost.

• If any equipment is lost, stolen, or unaccounted for at the end of your reservation, replacement fees may apply and may be charged to your payment method on file.

• Phone Charger — $40

• Turkish Towel — $20

• Bluetooth Speaker — $50

 

Weather and Safety

Your safety always comes first. Shady Beaches may cancel or adjust reservations due to unsafe weather or beach conditions. Only Shady Beaches staff can move, adjust, or remove equipment. If we cancel for safety, you’ll receive a full refund per Section 4.

Please respect the Cherry Grove beach and community. Notify us if conditions change. Keep the shoreline clean and please be courteous. Cherry Grove is a special place—our goal is to keep the vibe relaxed and welcoming to all.
